White House proposes cybersecurity legislation update

a letter by Director Jacob J. Lew to Congress’s President of the Senate and Speaker of the House as proposed legislation to update existing federal cyber security laws and regulations. Some key elements include

  • elevations and additions of punishment for computer fraud including forfeiture of property, fines, and imprisonment
  • notification guidelines, goals, and methods for entities using personally identifiable information (PII) of more than 10,000 individuals in any 12 month period (including exemptions for FBI, Secret Service, Safe Harbor under risk assessments, etc)
  • DHS recruitment, authority, and retention of cyber security employees
